USCIS Announces That H-2B Cap Has Been Reached

 

January 4, 2005 - USCIS announced today that it has received enough H-2B petitions to fill the FY2005 quota of 66,000 new workers. The H-2B category includes temporary workers performing nonagricultural services or labor, generally for a period of one year or less, on either an intermittent, seasonal, peakload, or one-time basis. For the remainder of FY 2005 (ending September 30, 2005), USCIS states:

· USCIS will process all petitions received by the end of business on January 3, 2005
· USCIS will return all petitions subject to the annual cap filed after January 3, 2005
· Petitioners may re-submit or file new petitions when they have received labor certification approval for work to start on or after October 1, 2005.
